Terms of Service

Effective date: September 1, 2026

These terms are the agreement between you and Gardenpatch ("Gardenpatch," "we," "us") for everything you buy or use at gardenpatch.xyz. We wrote them in plain language on purpose. If something here is unclear, email hello@gardenpatch.xyz and a person will answer.

1. Agreeing to these terms

By creating access, making a purchase, starting a membership, booking a session, or using the Agent API, you agree to these terms and to our Privacy Policy. If you are buying for a company, you confirm you are allowed to bind that company. You must be at least 18 to buy from us.

2. What we sell

• Playbooks ($27, one time). A PDF plus an interactive portal for one growth discipline. Access does not expire. No coach is included.
• Coach memberships ($99/month for one coach, $499/month for all coaches). Ongoing access to AI coaches that work through the playbooks with you and remember your business between sessions. Usage limits apply and are shown inside the product.
• Strategy sessions ($250 for 25 minutes, $450 for 50). Live one-to-one sessions with Tiago, booked and paid separately.
• Agent API. Metered, pay-per-call access for software agents, billed in credits as described at /for-agents.
• Free tier. Some coach conversations are free within a daily cap. We can change or pause the free tier at any time without notice.

Prices are in US dollars and are the prices shown at checkout at the time you buy. If we change a price, existing memberships keep their price unless we tell you at least 30 days before a renewal.

3. Payments, renewals, and cancelling

• Payments are processed by Stripe. We never see or store your full card number. Stripe's own terms apply to the payment itself.
• Memberships are month to month and renew automatically on the same day each month until you cancel.
• Cancel anytime. Cancel yourself from your portal under Manage billing, or email us and we will do it. Cancelling stops the next charge. You keep access until the end of the period you already paid for. We do not prorate partial months.
• If a renewal payment fails, we will retry it and email you. If it keeps failing, your membership pauses until you update your card.
• You are responsible for any taxes that apply to your purchase. Where we are required to collect tax, it is shown at checkout.

4. Refunds and the guarantee

One-time playbook purchases come with a 14-day money-back guarantee. If a playbook does not help you within 14 days of purchase, request a refund and we process it within 48 hours, no questions asked. One refund per playbook purchase. Portal access for a refunded purchase is revoked.

Memberships are not covered by the guarantee because you can cancel at any time and are never billed again. Strategy sessions can be rescheduled with 24 hours notice; a session you miss without notice is not refunded. Agent API credits are not refundable once used.

5. Your access and your account

• Access is tied to the email address you used at checkout. Keep it private. You are responsible for anything done through your access link or portal.
• A purchase is for you, or for the one business you name, and cannot be shared, resold, or transferred without our written permission.
• Tell us right away if you think someone else is using your access.

6. The AI coaches

Our coaches are AI systems. They are built on our playbooks and on what you tell them, and they are good at turning strategy into a plan. They are not human advisors, and they can be wrong. Nothing a coach says is legal, financial, tax, medical, or other professional advice. Check anything important before you act on it. You decide what to do in your business, and you own the outcome.

To make the coaches useful across sessions, we store facts you share with them, keyed to your email, as described in the Privacy Policy. Do not share anything you are not comfortable having stored, and do not share other people's personal data without their permission.

7. What you can and cannot do

You agree not to:

• copy, republish, or sell our playbooks, portal content, or coach conversations;
• use the coaches or API to build a competing product, or to train an AI model;
• scrape, probe, overload, or interfere with the site or API;
• bypass usage limits, free-tier caps, or access controls;
• use the service for anything unlawful, harmful, or abusive.

8. Ownership

Gardenpatch owns the playbooks, portal, coaches, site, and everything in them. You get a personal, non-exclusive, non-transferable license to use what you bought for your own business. You own the plans, notes, and answers you create with the product. You give us permission to use what you type in order to run the service for you, and, only if you say yes separately, to quote you as a testimonial.

9. Affiliates and third parties

Our affiliate program has its own Program Terms. We use Stripe for payments, OpenAI and Anthropic for AI, and other providers listed in the Privacy Policy. We are not responsible for those services, but we choose them carefully.

10. No warranty, and limits on liability

The service is provided as is. We do not promise it will be uninterrupted, error free, or that any playbook or coach will produce a particular business result. To the fullest extent the law allows, Gardenpatch is not liable for indirect, incidental, or consequential damages, including lost profits, and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Some places do not allow these limits, so they may not fully apply to you.

11. Ending the agreement

You can stop using the service at any time and cancel any membership as described above. We can suspend or end your access if you break these terms, with a refund of any unused prepaid period unless the breach was serious. Sections 6 through 12 survive after the agreement ends.

12. Changes, law, and disputes

• We may update these terms. If a change matters to you, we will email members and post the new effective date here at least 14 days before it takes effect. Continuing to use the service after that date means you accept the change.
• These terms are governed by the laws of the State of Nevada, USA, without regard to its conflict of law rules.
• If we have a dispute, email us first and we will try to sort it out within 30 days. If that fails, either of us may bring a claim in the state or federal courts located in Clark County, Nevada, and you agree to that venue.
